1. Agreement

By using Twilper Chat or purchasing a Twilper Chat subscription, you agree to these terms. If you do not agree, do not use the service.

2. Services

Twilper Chat brings website chat, connected email, WhatsApp and phone calls together in one shared team workspace. An AI assistant can answer website chat, WhatsApp messages and phone calls on your behalf, based on your knowledge base, the integrations you connect and the rules you set. AI-assisted email replies are drafts for a team member to review and send. Phone numbers, call minutes and WhatsApp are add-ons that may carry separate usage costs. Features and usage limits depend on the selected subscription plan.

3. Digital Products

Twilper Chat and its included software components are licensed for the subscription period. You may not copy, resell, or redistribute the software except where applicable law allows it.

4. Payment

Subscription price, billing interval, renewal, and applicable VAT are shown during checkout. Paid subscriptions renew according to the selected interval until cancelled through the customer account or by contacting support. Payment processing is handled by the provider shown during checkout.

5. Withdrawal from a consumer purchase

Consumers may have a statutory right to withdraw from a distance contract within 14 days, subject to statutory conditions and exceptions. Where available, use the “Withdraw purchase” action beside an eligible paid order in your customer account and confirm your statement. We will send an acknowledgement by email. This online function is additional to the model withdrawal form and other legally permitted ways to notify us. Consumer withdrawal rights do not apply to business purchases. Contact [email protected] if you cannot access your account or need to submit a statement another way.

6. Intellectual Property

Twilper and its licensors retain ownership of Twilper Chat, its software, and related intellectual property. You retain rights to the content and data you submit to the service.

7. Twilper Chat — Service Terms

These terms describe the Twilper Chat workspace for website chat, connected email, WhatsApp and phone calls, including the AI assistant.

7.1 Service Description

Twilper Chat provides a shared workspace for website chat, connected email, WhatsApp and phone calls. The AI assistant answers visitors, WhatsApp contacts and callers within the limits of your knowledge base, connected integrations and rules, and hands conversations over to your team when needed. AI-assisted email replies remain editable drafts until a team member reviews and sends them. Call recording is off unless you turn it on; recordings are deleted after the retention period you choose.

7.2 Fair Use

• Each plan includes a monthly message limit. Messages exceeding the limit may be throttled.
• The chatbot must not be used to generate misleading, harmful, or illegal content.
• You are responsible for the accuracy of your knowledge base content.
• Automated or bot-generated chat messages that inflate usage are prohibited.

7.3 AI Limitations

AI-generated answers and drafts may be incomplete or inaccurate. You are responsible for the content of your knowledge base, the rules and settings you choose, and for reviewing email drafts before sending them.

7.4 Data Responsibility

You determine which personal data you add to the workspace and must provide any notices and instructions required for your use of Twilper Chat. Our privacy policy describes how Twilper processes customer and conversation data.

7.5 Uptime

The service depends on internet access and third-party infrastructure. We may perform maintenance or make changes to keep the service secure and operational.

7.6 Cancellation

You can request cancellation through your customer account or by contacting support. Access and data handling after cancellation follow the subscription terms and the retention information in our privacy policy. Contact support to request deletion of workspace data.

8. Liability

• 8.1 For business customers, Twilper's total liability arising out of or in connection with Twilper Chat, whether in contract, tort or otherwise, is limited to the amount you paid for Twilper Chat in the twelve months before the event that caused the damage, with a minimum of EUR 500.
• 8.2 Twilper is not liable to business customers for indirect or consequential loss, including lost profit, lost revenue, lost savings, reputational damage, or loss of data that you could reasonably have exported or backed up yourself.
• 8.3 These limits do not apply to damage caused by intent or deliberate recklessness (opzet of bewuste roekeloosheid) of Twilper's management, to liability that cannot be limited under applicable law, or to the statutory rights of consumers.
• 8.4 The data processing agreement governs the processing of personal data on your behalf. The limits in this section also apply to claims under that agreement, as far as the law allows.
• 8.5 A claim for damages must be reported to [email protected] within twelve months after you became aware, or could reasonably have become aware, of the damage.

9. Changes to these terms

We may change these terms. We notify existing customers by email or in the workspace at least 30 days before a material change takes effect, unless a shorter period is required by law or by a provider we depend on. If you do not agree with a change, you may cancel before it takes effect.

10. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes will be resolved through the courts of the Netherlands.
